These terms regulate the rental of boats through the website calasdemallorcacharter.com and the Turitop booking system.
1. Purpose of the Contract
Temporary rental of recreational boats managed by Calas de Mallorca Charter, for leisure use within the authorized navigation areas.
2. Minimum Age and Documentation
– Minimum age of the skipper: 18 years.
– For boats that require a license, the client must present a valid nautical license recognized in Spain (physical format or photo).
– Failure to present the required license will prevent the rental with no right to refund of the booking.
3. Price, Booking and Payment Method
– The price shown on the website is the total rental price.
– To confirm the booking, the applicable booking fee is paid online at the time of reservation.
– The booking fee is deducted from the total rental price.
– The remaining balance is paid on the day of rental, before departure.
– Online payment is managed exclusively through Turitop.
– The rental price does not include the security deposit, which is paid separately.
4. Security Deposit
– The deposit is independent from the rental price and the online booking.
– The amount varies depending on the boat.
– Boats without license: deposit in cash only.
– Boats with license: deposit in cash or card.
– The deposit is returned at the end of the rental after checking the boat’s condition.
– It will not be returned in case of damage, negligent use, extreme dirt, breach of rules, or leaving the authorized navigation areas.
5. Check-in and Return
– The client must arrive 15 minutes before the departure time.
– The boat must be returned at the agreed time.
– Delays: €50 for every 15 minutes.
– If the delay affects another client, any resulting loss may be charged.
6. Use of the Boat
The client agrees to:
– Not exceed maximum capacity.
– Not navigate under the influence of alcohol or drugs.
– Respect safety distances, navigation zones, and anchoring areas.
– Not perform dangerous maneuvers or tow other boats.
– Turn off the engine while swimming or anchoring.
– Respect marine life and the natural environment.
7. Navigation Limits
Navigation is restricted to the areas indicated by staff before departure.
Leaving these areas results in total loss of the security deposit.
8. Fuel
– Fuel is included for boats without a license.
– Fuel is not included for boats that require a license.
– The boat must be returned under the conditions indicated by the staff.
– Failure to comply will result in charging the missing fuel plus a service fee.
9. Weather Conditions
– If conditions are unsafe, the rental may be canceled or postponed.
– In case of real bad weather, the client will be offered a date change at no cost, or if not possible, a refund of the booking amount.
10. Cancellations
– More than 7 days before: 100% refund of the booking.
– Less than 7 days: no refund of the booking.
– No-show on the rental day results in total loss of the booking.
– Late arrival does not entitle the client to extend the rental time.
11. Breakdowns and Damage
– Any incident must be reported immediately.
– Damage caused by misuse will be deducted from the deposit.
– If the damage exceeds the deposit, the client must pay the difference.
12. Safety
– The client will receive basic instructions before departure.
– Staff instructions must be followed at all times.
– Life jackets are recommended and mandatory in certain cases.
13. Liability
The client is responsible for the boat, all passengers, and any penalties resulting from violations of maritime regulations.
14. Right of Withdrawal
In accordance with current regulations, the right of withdrawal does not apply, as this is a leisure service with a specific date.
By completing the booking, the client expressly accepts this condition.
15. Modification of Terms
Calas de Mallorca Charter may modify these terms. The applicable terms will be those in force at the time of booking.
